Terms of Service
Effective July 12, 2026. Grady is a product of Consultspot, Inc. ("Grady", "we").
1. The service
Grady sends schedules to, calls, and texts a customer's subcontractors to confirm availability, and reports the results back to the customer's team. AI conversations and interpretations are imperfect by nature; Grady presents material schedule changes for human confirmation, and the customer remains responsible for its schedules and job-site decisions. Grady is a coordination tool, not a safety system. Do not rely on it as the sole notice for anything where failure endangers people or property.
2. Customer responsibilities
- Provide subcontractor contact information you have the right to use.
- Grady obtains each subcontractor's documented opt-in before any calls or texts and honors opt-outs automatically. Do not attempt to bypass, re-enroll, or otherwise contact opted-out individuals through Grady.
- Comply with the laws that apply to your use, including any notice obligations you have to workers about call recording in the states where you operate.
- Keep your account credentials secure. You are responsible for actions taken through your team's accounts.
3. Fees
Pricing, seats, included usage, and any usage-based charges are set out in your order form or pilot agreement. Optional usage-based overage applies only when you explicitly enable it with a card on file.
4. Your data
As between you and Grady, you own your data: schedules, subcontractor information, and call and message content. We process it as described in the Privacy Policy. Call recordings and transcripts are retained for 90 days. On termination, we will export your data on request and delete it within 30 days.
5. Acceptable use
Grady's calling and texting may not be used for marketing, solicitation, debt collection, political or emergency messaging, or to contact anyone who is not your subcontractor or staff. We may suspend numbers or accounts that generate carrier complaints or violate these terms.
6. Availability
We work to keep Grady available and will use commercially reasonable efforts to do so, but we do not offer an uptime guarantee at this stage.
7. Disclaimers and liability
Grady is provided as-is, without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, our total liability for any claims arising out of the service is limited to the fees you paid us in the twelve months before the claim, and neither party is liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited by law.
8. Term and termination
Pilots run month to month unless the order form says otherwise, and either party may terminate as set out there. Sections 4, 7, and 9 survive termination, along with any fees owed.
9. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
